Terms of Service

These Terms of Service ("Terms") govern your use of the Bark Talk mobile application ("App"), operated by Giig ApS ("we", "us", or "our"), a company registered in Denmark. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent that you meet these requirements.

2. Account Registration

To use BarkTalk, you must sign in using a third-party authentication provider (Apple, Google, or Facebook). By signing in, you authorize us to access limited profile information (such as your name and email address) as provided by the authentication provider. You are responsible for maintaining the security of your account and for all activity that occurs under it.

3. Description of Service

BarkTalk allows you to upload photos of dogs and generate AI-powered videos of those dogs appearing to talk. Photos you upload are transmitted to a third-party AI service for processing. The generated video is returned to you within the App. We do not guarantee the availability, accuracy, or quality of the generated content.

4. Subscriptions and Purchases

BarkTalk offers a premium subscription ("BarkTalk Premium") that provides access to additional features and a limited number of free video generations per subscription period. Additional video generations beyond the included amount may be purchased as consumable in-app purchases.

• All purchases and subscriptions are processed through Apple via the App Store and are subject to Apple's terms and conditions.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your Apple ID account settings.
• Refunds are handled by Apple in accordance with their refund policy.
• Unused consumable purchases do not expire and remain available in your account.

5. User Content

You retain ownership of the photos you upload and the videos generated through the App. By using the App, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the service (including transmitting photos to our third-party AI processing provider). We do not use your content for any other purpose, and we do not claim ownership over any user-generated content.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful or fraudulent purpose
• Upload content that you do not have the right to use, or that infringes on the intellectual property rights of others
• Upload content depicting animal abuse, violence, or illegal activity
• Use the App to create misleading, defamatory, or harmful content
• Attempt to reverse engineer, decompile, or otherwise exploit the App
• Interfere with or disrupt the operation of the App or its infrastructure
• Use the App in any manner that could damage, disable, or impair the service

We reserve the right to suspend or terminate your account if you violate these Terms.

7. Intellectual Property

The App, including its design, code, graphics, logos, and trademarks, is owned by Giig ApS and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

8. Third-Party Services

The App relies on third-party services for authentication (Apple, Google, Facebook) and AI-powered video generation. We are not responsible for the availability, performance, or practices of these third-party services. Your use of third-party authentication providers is subject to their respective terms and privacy policies.

9. Account Deletion

You may delete your account and associated data at any time from within the App. You may also request account deletion by contacting us at support@barktalkapp.com. Upon deletion, your account data will be permanently removed. Active subscriptions must be cancelled separately through your Apple ID account settings.

10. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Giig ApS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the App. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Giig ApS, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last updated" date and, where appropriate, providing notice within the App. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Denmark.
